What is a bill of sale and do I need one?

A bill of sale is a signed, dated document naming the buyer, seller, item, and price, and it is the written proof that a sale happened. Most states do not require one for a private, non-vehicle sale, but many DMVs recommend or require a bill of sale to complete a vehicle title transfer, and a handful of states, including Louisiana and Montana, require the vehicle bill of sale to be notarized before the transfer goes through. The bill of sale itself does not transfer ownership: for a vehicle, the signed title is the legal transfer document, and the bill of sale is the supporting record, with many states also using the sale price on it to calculate transfer tax. A few practical notes before you sign

A bill of sale is not proof of a clean title. Always check for liens before you buy a vehicle or expensive item.
Keep a copy for your own records even after you hand the original to the other party.
If the item is financed, the lender's lien must be released before a clean sale can happen.
